License required

## Is non-medical home care licensed in Virginia?

Virginia licenses home care organizations through the Virginia Department of Health, Office of Licensure and Certification (OLC).

A home care organization is one that provides home health, personal care or pharmaceutical services in a person's home. Personal care means non-skilled help with activities of daily living such as bathing, dressing and toileting. The state rules do not apply to providers of only homemaker, chore or companion services, and they do not cover family members, relatives or friends who give care. Home health agency status is a separate federal Medicare certification for skilled nursing plus therapy. The state regulation (12VAC5-381) is still in force, and its fee and application sections were amended effective May 22, 2025.

**Tip:** Ask an agency that offers bathing or other personal care for its VDH home care organization license, and ask the Office of Licensure and Certification to confirm it, because companion-only agencies may be exempt. ## Virginia programs that can help pay.

Most families pay privately, with long-term care insurance or with veterans benefits. These programs can pay for help at home for people who qualify.

HCBS waiver

### Commonwealth Coordinated Care Plus (CCC Plus) Waiver

**Who:** Older adults, people with a physical disability, and people who are chronically ill or severely impaired and who would otherwise need a nursing facility or a long hospital stay. The person must meet nursing facility level of care, pass a screening, and be eligible for Medicaid.

What it covers

Personal care (agency-directed or consumer-directed), respite, adult day health care, personal emergency response systems, assistive technology, environmental modifications and private duty nursing. The 2025 fact sheet lists a soft cap of 56 personal care hours per week, with exceptions, and 480 respite hours per state fiscal year.

**Family caregivers:** Yes. Members can direct their own personal care and respite by hiring an attendant, and DMAS lists companion services as directable too; spouses and parents of minors (legally responsible individuals) may be paid for extraordinary personal care up to 40 hours per week.

### Program of All-Inclusive Care for the Elderly (PACE)

**Who:** Adults age 55 or older who live in a PACE service area, can live safely in the community, and qualify for nursing facility level of care by the Virginia Uniform Assessment Instrument (per Sentara PACE).

What it covers

Medical care, rehabilitation, in-home services and transportation through one PACE organization, which must furnish or authorize all services.

[Official page](https://www.dmas.virginia.gov/for-providers/benefits-services-for-providers/long-term-care/programs-and-initiatives/program-of-all-inclusive-care/)

**Income limit:** The DMAS July 2026 eligibility chart, 'Categorically Needy 300% of SSI', lists $2,982 per month for one person, effective January 2026. Long-term care Medicaid in Virginia uses this limit for many groups. Other rules apply, so confirm with the local Department of Social Services.

Rules change; confirm with [Virginia Department of Medical Assistance Services (DMAS)](https://www.dmas.virginia.gov/). A care advisor can talk through payment options.

About home care in Virginia

Home care in Virginia helps seniors who need assistance with “activities of daily living (ADL’s)” and their family. In-Home Care can be provided in Virginia by either a home care agency or private duty caregivers. Agencies have physical locations and are more strictly regulated by the state, but many more experienced caregivers decide to work directly for the family as private duty home health aides so they can avoid the agency overhead that cuts into their wages.

HomeCare.com specializes in connecting families with caregivers who meet their unique needs. Our care advisors have years of experience dedicated to assisting families through this process. We'd be happy to offer you a free consultation to discuss your specific requirements and help you find the best possible caregiver.
